The FidoNet Showcase Project

Introduction
The terms of Our Policies agreement (the "Agreement") governs your use of the collection of web pages, files and other digital content (the "Collections") available through the FidoNet Showcase Project (the "Project"). The Project is committed to making its constantly growing collection of content available to everyone for purposes of benefit to the public, especially to the Bulletin Board System Operators (BBS SysOps). Free access to the Project's Collections is provided to you and is granted for everyone in good standing with the Project. By accessing or using materials from this web site, you acknowledge that you have read Our Policies and that you agree to be bound by these terms just as if you had signed an agreement. Therefore, please read Our Policies carefully. If you do not agree to be bound by these terms, do not use this web site.

Privacy

Email Addresses
The Project may collect the email addresses and messages of those who communicate with it via email or who enter email addresses in forms. This information becomes public. Any received email has been designated as private by its originator, will not be publically disclosed.

Logging Your Accesses
Whenever you visit our web site and access any information, you do not remain anonymous, our server does provide normal logging activities. Security scripts are in-place to monitor both authorized and unauthorized activities and automatically deny further ACCESS when appropriate. We believe this collected visit information should only be used by us to help provide you with better service.

Sharing of Private Information
We do not share your personal information to other companies or individuals. The Project may disclose any information it collects from Users if the Project believes in good faith that such action is reasonably necessary to enforce its Terms of Use, its Policies, its Copyright or other policies, to comply with the law, to comply with legal process, to operate its systems properly, or to protect the rights or property of itself, its Users, or others.

Submissions
When you submit content, the Project will maintain the confidence of your personally identifying information according to the Terms of Use and in accordance with the Project's Privacy Policy unless you specially indicate in writing, at the time of submission, that your name can be publically disclosed for that submission.

Web Site Content

The primary sources of content for the Collections are publicly accessible web pages, files and documents that were collected and donated by third parties, and by the collection efforts of the Project which had started in 1996. On January 1st, 2001, the Project started the on-line display of its Collections. Other web sites of similar theme, are encouraged to link to our home page of the Project.

Annoying Web Site Practices
The Project DOES NOT:

  • Display banners or pop-up advertisements,
  • Mass email our users,
  • Play music or other audio,
  • Prevent you from leaving a page or our web site,
  • Use "cookies" to track User activities,
  • Did I miss one?

Dispute with Contents

    Conflict with a Copyright or Property Rights For instructions on removing a particular set of pages or files currently included in the Collections, please refer to the  Copyright Notice  under the title of Conflict with a Copyright or Property Rights.

    All Other Conflicts Not Related to the Above
    The Project will resolve all other conflicts with content in accordance with current established policies, in a fair manner, consistence with the spirit of the law. Send all requests to  The FidoNet Showcase Project.  

Linking

    To the Project Web Site
    You are encouraged to link to the Project's home page at   http://winramturbo.com/fnsp/   and not the other pages on the web site since they are still changing in name as the site grows, and they may change name or disappear at any time, without prior notice. All content is available to the public, however, please do not modify any of the logos, marks, or other distinctive graphics that were created by the Project. You may not link in any manner reasonably likely to:

    1. Cause confusion, mistake, or deception,
    2. Dilute the Project's copyrights, trademarks or service marks,
    3. Imply affiliation with or endorsement or sponsorship by the Project,
    4. Violate state or federal law.

    To Third Party Sites
    The Project contains links to Internet sites maintained by third parties. The Project does not control such third parties and does not operate or control any information, products or services on those third party web sites. Third party links are included solely for the convenience of our Users and Visitors to our web site and do not constitute any endorsement by the Project. Both Users and Visitors to our web site assume sole responsibility for use of third party links and pointers. The Project's disclaimers in the Terms of Use, the Copyright Notice and Our Policies are applicable to third party web sites.

Submissions
Individuals are encouraged to make donations of information and files that they may have in their possession which could be used in the Project. A submission form is available on the web site to upload your files or to send feedback information to the Project. When submitting any content to the Project by any means, to include emails, you grant to the Project and its affiliates, a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use that content in a consistent manner without violating an existing copyright for that content. The Project may incorporate such materials in other works in any form, media or technology now known or later developed within the spirit of the law, providing no copyright is violated. No fees will be paid for any submissions.

We Reserve the Right

  1. To deny ACCESS to our web site to anyone who is NOT in good standing with the Project.
  2. To reject any submitted content for the Project and having final say as such.
  3. To refuse to display any information or provide certain files for downloading if the content is determined not within the best interests of the Project.
  4. To deny ACCESS to anyone using anonymous browsing techniques since we monitor the server for security reasons.
  5. To deny ACCESS to any linking web site or robot or harvester that is creating excessive bandwidth problems or multiple file errors.

Unauthorized Activities

Abuse by Human or Electronic Visitors to Web Site
Upon determination of such action, excessive bandwidth problems or multiple file errors, initiated by any person, crawler, harvester, robot, spider, or other electronic mechanism, and without notification to the same, the offender will be permanently BANNED from our server, to be determined at our own discretion.

Web Site Compromised
It is possible that the web site for the Project could become compromised by others and that the information on the Project's web site could be collected and disseminated without the knowledge or consent of the Project. While the Project endeavors to block "crackers" from breaking into its web server, the Project is not responsible or liable for any such unauthorized uses of the Project or its data.

Updating of Agreement

The Project may make changes to this policy from time to time and will post an updated date at the top of the Terms of Use, Our Policies, and Copyright Notice under their respective titles. Your use of the Project and/or the Collections constitutes your acceptance of any changes to these policies concerning, but not limited to, both previously and prospectively collected information.
